The Need to Mention Conditions after Nikah

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عَبْدِ اللهِ بْنِ بُكَيْرٍ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) مَا كَانَ مِنْ شَرْطٍ قَبْلَ النِّكَاحِ هَدَمَهُ النِّكَاحُ وَمَا كَانَ بَعْدَ النِّكَاحِ فَهُوَ جَائِزٌ وَقَالَ إِنْ سُمِّيَ الأجَلُ فَهُوَ مُتْعَةٌ وَإِنْ لَمْ يُسَمَّ الأجَلُ فَهُوَ نِكَاحٌ بَاتٌّ.
1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Abd Allah ibn Bukayr who has said the following: “Any condition before marriage becomes invalid by marriage and the condition after marriage is permissible.’ He (the Imam) said, ’If time limit is mentioned it is al-Mut‘ah (advantageous marriage) and if time limit is not mentioned it is permanent.’”

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ قَوْلِ اللهِ عَزَّ وَجَلَّ وَلا جُناحَ عَلَيْكُمْ فِيما تَراضَيْتُمْ بِهِ مِنْ بَعْدِ الْفَرِيضَةِ فَقَالَ مَا تَرَاضَوْا بِهِ مِنْ بَعْدِ النِّكَاحِ فَهُوَ جَائِزٌ وَمَا كَانَ قَبْلَ النِّكَاحِ فَلا يَجُوزُ إِلا بِرِضَاهَا وَبِشَيْءٍ يُعْطِيهَا فَتَرْضَى بِهِ.
2. A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub from ibn Ri’ab from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the words of Allah, most Majestic, most Glorious, 4 . . . it is not harmful for you if you agree upon it after marriage.’ (4:24) He (the Imam) said, ‘Whatever they agree upon after marriage is permissible and whatever is before marriage is not permissible except with her agreement and with something given to her to make her agree.’”

3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ أَبِيهِ عَنْ سُلَيْمَانَ بْنِ سَالِمٍ عَنِ ابْنِ بُكَيْرٍ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِذَا اشْتَرَطْتَ عَلَى الْمَرْأَةِ شُرُوطَ الْمُتْعَةِ فَرَضِيَتْ بِهِ وَأَوْجَبَتِ التَّزْوِيجَ فَارْدُدْ عَلَيْهَا شَرْطَكَ الأوَّلَ بَعْدَ النِّكَاحِ فَإِنْ أَجَازَتْهُ فَقَدْ جَازَ وَإِنْ لَمْ تُجِزْهُ فَلا يَجُوزُ عَلَيْهَا مَا كَانَ مِنَ الشَّرْطِ قَبْلَ النِّكَاحِ.
3. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father from Sulayman ibn Salim from ibn Bukayr who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘When you settle the conditions of al-Mut‘ah (advantageous marriage) with a woman and she agrees and marriage becomes binding, you can bring your prior condition after marriage; if she agrees it is permissible, if she does not agree, it does not apply effectively to her; it was before marriage.’”

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) يَقُولُ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ مُتْعَةً أَنَّهُمَا يَتَوَارَثَانِ إِذَا لَمْ يَشْتَرِطَا وَإِنَّمَا الشَّرْطُ بَعْدَ النِّكَاحِ.
4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Muhammad ibn Muslim who has said the following: “I once heard abu Ja‘far, ‘Alayhi al-Salam, saying, about the case of a man who marries in the manner of al-Mut‘ah (advantageous marriage) ‘They inherit each other if they do not set a condition because condition is effective after marriage.’”

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ سُلَيْمَانَ بْنِ سَالِمٍ عَنِ ابْنِ بُكَيْرِ بْنِ أَعْيَنَ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِذَا اشْتَرَطْتَ عَلَى الْمَرْأَةِ شُرُوطَ الْمُتْعَةِ فَرَضِيَتْ بِهَا وَأَوْجَبَتِ التَّزْوِيجَ فَارْدُدْ عَلَيْهَا شَرْطَكَ الأوَّلَ بَعْدَ النِّكَاحِ فَإِنْ أَجَازَتْهُ جَازَ وَإِنْ لَمْ تُجِزْهُ فَلا يَجُوزُ عَلَيْهَا مَا كَانَ مِنَ الشَّرْطِ قَبْلَ النِّكَاحِ.
5. Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Sulayman ibn Salim from ibn Bukayr ibn ‘A‘yan who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘When you settle the conditions of al-Mut‘ah (advantageous marriage) with a woman and she agrees, marriage becomes binding; you can bring your prior condition after marriage, if she agrees it is permissible; if she does not agree it does not apply effectively to her; it was before marriage.’”
