Conditions of al-Mut‘ah (Advantageous Marriage)

1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَمُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ صَالِحٍ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا تَكُونُ مُتْعَةٌ إِلا بِأَمْرَيْنِ أَجَلٍ مُسَمًّى وَأَجْرٍ مُسَمًّى.
1. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from ibn Mahbub from Jamil ibn Salih from Zurarah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Al-Mut‘ah (advantageous marriage) cannot take place without two issues: they are the duration of time and the amount of mahr (dower).”’

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ عَنْ أَبِي بَصِيرٍ قَالَ لا بُدَّ مِنْ أَنْ تَقُولَ فِي هَذِهِ الشُّرُوطِ أَتَزَوَّجُكِ مُتْعَةً كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً نِكَاحاً غَيْرَ سِفَاحٍ عَلَى كِتَابِ اللهِ عَزَّ وَجَلَّ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) وَعَلَى أَنْ لا تَرِثِينِي وَلا أَرِثَكِ وَعَلَى أَنْ تَعْتَدِّي خَمْسَةً وَأَرْبَعِينَ يَوْماً وَقَالَ بَعْضُهُمْ حَيْضَةً.
2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn and a number of our people have narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from Sama‘ah from abu Basir who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, ‘It is necessary that in marriage in the manner of al- Mut‘ah (advantageous marriage) and its conditions one must say, “I form marriage with you in the manner of al-Mut‘ah (advantageous marriage) for so and so many days with such and such amount of dirham as mahr (dower), a marriage free of indecency according to the book of Allah, most Majestic, most Glorious, and the Sunnah of Allah’s Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, that you will not inherit me and I will not inherit you and that you must complete forty- five days of waiting period’” and certain ones have said that it is one cycle of Hayd (menses).”

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ عَنْ أَبَانِ بْنِ تَغْلِبَ وَعَلِيُّ بْنُ مُحَمَّدٍ عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ إِسْمَاعِيلَ بْنِ مِهْرَانَ وَمُحَمَّدِ بْنِ أَسْلَمَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ عَنْ أَبَانِ بْنِ تَغْلِبَ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) كَيْفَ أَقُولُ لَهَا إِذَا خَلَوْتُ بِهَا قَالَ تَقُولُ أَتَزَوَّجُكِ مُتْعَةً عَلَى كِتَابِ اللهِ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) لا وَارِثَةً وَلا مَوْرُوثَةً كَذَا وَكَذَا يَوْماً وَإِنْ شِئْتَ كَذَا وَكَذَا سَنَةً بِكَذَا وَكَذَا دِرْهَماً وَتُسَمِّي مِنَ الأجْرِ مَا تَرَاضَيْتُمَا عَلَيْهِ قَلِيلا كَانَ أَمْ كَثِيراً فَإِذَا قَالَتْ نَعَمْ فَقَدْ رَضِيَتْ فَهِيَ امْرَأَتُكَ وَأَنْتَ أَوْلَى النَّاسِ بِهَا قُلْتُ فَإِنِّي أَسْتَحْيِي أَنْ أَذْكُرَ شَرْطَ الأيَّامِ قَالَ هُوَ أَضَرُّ عَلَيْكَ قُلْتُ وَكَيْفَ قَالَ إِنَّكَ إِنْ لَمْ تَشْتَرِطْ كَانَ تَزْوِيجَ مُقَامٍ وَلَزِمَتْكَ النَّفَقَةُ فِي الْعِدَّةِ وَكَانَتْ وَارِثَةً وَلَمْ تَقْدِرْ عَلَى أَنْ تُطَلِّقَهَا إِلا طَلاقَ السُّنَّةِ.
3. Ali ibn Ibrahim has narrated from his father from “Amr ibn ‘Uthman from Ibrahim ibn al-Fadl from Aban ibn Taghlib and Ali ibn Muhammad from Sahl ibn Ziyad from ‘Isma’il ibn Mehran and Muhammad ibn Muslim from Ibrahim ibn al-Fadl from Aban ibn Taghlib who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about what I should say when I am with her. He (the Imam) said, ‘Say I marry you in the manner of al-Mut‘ah (advantageous marriage) according to the book of Allah and the Sunnah of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and that there is no inheritor or inherited in it, for so and so many days or if you wished, for so and so many years, for so and so much amount of dirham as mahr (dower),’ mention the amount you both have agreed, little or more, then if she said, “Yes,” it means she has agreed. She is your wife and you are the nearest of all people to her.’ I then said, ‘I feel embarrassed to mention the condition of days.’ He (the Imam) said, ‘It (such feeling) is more harmful to you.’ I then asked, ‘Why is it as such?’ He (the Imam) said, ‘If you do not mention, marriage is permanent, you must pay her expenses during waiting period, there will be inheritance and you cannot divorce her except in the form of divorce according to the Sunnah.’”

4- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَصْرٍ عَنْ ثَعْلَبَةَ قَالَ تَقُولُ أَتَزَوَّجُكِ مُتْعَةً عَلَى كِتَابِ اللهِ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) نِكَاحاً غَيْرَ سِفَاحٍ وَعَلَى أَنْ لا تَرِثِينِي وَلا أَرِثَكِ كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً وَعَلَى أَنَّ عَلَيْكِ الْعِدَّةَ.
4. Ali ibn Ibrahim has narrated from his father from ibn abu Nasr from Tha’labah who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, say, ‘I marry you in the manner of al-Mut‘ah (advantageous marriage) according to the book of Allah and the Sunnah of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, a marriage which is not indecency and that you will not inherit me and I will not inherit you, for so and so amount of dirham as mahr (dower) and that you must complete the waiting period.’”

5- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ سَالِمٍ قَالَ قُلْتُ كَيْفَ يَتَزَوَّجُ الْمُتْعَةَ قَالَ تَقُولُ يَا أَمَةَ اللهِ أَتَزَوَّجُكِ كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً فَإِذَا مَضَتْ تِلْكَ الأيَّامُ كَانَ طَلاقُهَا فِي شَرْطِهَا وَلا عِدَّةَ لَهَا عَلَيْكَ.
5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad ibn abu ‘Umayr from Hisham ibn Salim who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about how al-Mut‘ah (advantageous marriage) is formed?’ He (the Imam) said that you must say, ‘O female servant of Allah, I marry you for so and so many days for such and such amount of dirham as mahr (dower).’ When the days pass her divorce is her condition and she does not need waiting period.’”
