Al-Mut‘ah (advantageous marriage) Is Not Permissible With Non-Chaste Women

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبَانٍ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) أَنَّهُ سُئِلَ عَنِ الْمُتْعَةِ فَقَالَ إِنَّ الْمُتْعَةَ الْيَوْمَ لَيْسَ كَمَا كَانَتْ قَبْلَ الْيَوْمِ إِنَّهُنَّ كُنَّ يَوْمَئِذٍ يُؤْمَنَّ وَالْيَوْمَ لا يُؤْمَنَّ فَاسْأَلُوا عَنْهُنَّ.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Aban from abu Maryam who has said the following: “Once, abu Ja‘far, ‘Alayhi al-Salam, was asked about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Al-Mut‘ah (advantageous marriage) today is not like it was before this day. Women in those days believed in it but today they do not believe in it and you can ask them.”’

2- وَعَنْهُ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْعَبَّاسِ بْنِ مُوسَى عَنْ إِسْحَاقَ عَنْ أَبِي سَارَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْهَا يَعْنِي الْمُتْعَةَ فَقَالَ لِي حَلالٌ فَلا تَتَزَوَّجْ إِلا عَفِيفَةً إِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ وَالَّذِينَ هُمْ لِفُرُوجِهِمْ حافِظُونَ فَلا تَضَعْ فَرْجَكَ حَيْثُ لا تَأْمَنُ عَلَى دِرْهَمِكَ.
2. It is narrated from the narrator of the previous Hadith from Ahmad ibn Muhammad from al-‘Abbas ibn Musa from Ishaq from abu Sarah who has said the following: “This is concerning my question before abu ‘ Abd Allah, Alayhi al-Salam, about it ( al-Mut‘ah (advantageous marriage)). He (the Imam) said to me, Tt is lawful but you must not marry except those who possess chastity; Allah, most Majestic, most Glorious, says, “. . .those who protect their private organs. ”(23: 5) Therefore, do not marry one whom you cannot trust about your dirham.’”

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ سَأَلَ رَجُلٌ أَبَا الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) وَأَنَا أَسْمَعُ عَنْ رَجُلٍ يَتَزَوَّجُ امْرَأَةً مُتْعَةً وَيَشْتَرِطُ عَلَيْهَا أَنْ لا يَطْلُبَ وَلَدَهَا فَتَأْتِي بَعْدَ ذَلِكَ بِوَلَدٍ فَشَدَّدَ فِي إِنْكَارِ الْوَلَدِ وَقَالَ أَيَجْحَدُهُ إِعْظَاماً لِذَلِكَ فَقَالَ الرَّجُلُ فَإِنِ اتَّهَمَهَا فَقَالَ لا يَنْبَغِي لَكَ أَنْ تَتَزَوَّجَ إِلا مُؤْمِنَةً أَوْ مُسْلِمَةً فَإِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ الزَّانِي لا يَنْكِحُ إِلا زانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لا يَنْكِحُها إِلا زانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذلِكَ عَلَى الْمُؤْمِنِينَ.
3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “A man once asked al-Rida’, Alayhi al-Salam, when I was listening, about the case of a man who married a woman in the manner of al-Mut‘ah (advantageous marriage) with the condition that he was not to support her child. She thereafter brought a child to him and he strongly denied the child. He (the Imam) said, ‘Does he deny it because of its greatness?’ The man replied, ‘He accuses her (of wrong doing).’ He (the Imam) said, it is not proper for you to marry anyone other than believing, Muslim female because Allah, most Majestic, most Glorious, says, “The fornicator cannot marry but a female fornicator or a female pagan and a female fornicator cannot marry anyone other than a male fornicator or a pagan and it is unlawful to believing people.” (23:3)’”

4- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ رَفَعَهُ عَنْ عَبْدِ اللهِ بْنِ أَبِي يَعْفُورٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الْمَرْأَةِ وَلا أَدْرِي مَا حَالُهَا أَيَتَزَوَّجُهَا الرَّجُلُ مُتْعَةً قَالَ يَتَعَرَّضُ لَهَا فَإِنْ أَجَابَتْهُ إِلَى الْفُجُورِ فَلا يَفْعَلْ.
4. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from in a marfu’ manner from ‘Abd Allah ibn abu Ya’fur who has said the following: “This is concerning my question before abu ‘Abd Allah, Alayhi al-Salam, about the case of a woman whose condition is not known; if a man can marry her in the manner of al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘He can propose unlawful activities; if she agreed, he then must stay away from her.’”

5- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ الْبَرْقِيِّ عَنْ دَاوُدَ بْنِ إِسْحَاقَ الْحَذَّاءِ عَنْ مُحَمَّدِ بْنِ الْفَيْضِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ فَقَالَ نَعَمْ إِذَا كَانَتْ عَارِفَةً قُلْنَا جُعِلْنَا فِدَاكَ فَإِنْ لَمْ تَكُنْ عَارِفَةً قَالَ فَاعْرِضْ عَلَيْهَا وَقُلْ لَهَا فَإِنْ قَبِلَتْ فَتَزَوَّجْهَا وَإِنْ أَبَتْ أَنْ تَرْضَى بِقَوْلِكَ فَدَعْهَا وَإِيَّاكَ وَالْكَوَاشِفَ وَالدَّوَاعِيَ وَالْبَغَايَا وَذَوَاتِ الأزْوَاجِ قُلْتُ مَا الْكَوَاشِفُ قَالَ اللَّوَاتِي يُكَاشِفْنَ وَبُيُوتُهُنَّ مَعْلُومَةٌ وَيُؤْتَيْنَ قُلْتُ فَالدَّوَاعِي قَالَ اللَّوَاتِي يَدَّعِينَ إِلَى أَنْفُسِهِنَّ وَقَدْ عُرِفْنَ بِالْفَسَادِ قُلْتُ فَالْبَغَايَا قَالَ الْمَعْرُوفَاتُ بِالزِّنَا قُلْتُ فَذَوَاتُ الأزْوَاجِ قَالَ الْمُطَلَّقَاتُ عَلَى غَيْرِ السُّنَّةِ.

A number of our people have narrated from Ahmad ibn Muhammad from al-Barqiy from Dawud ibn Ishaq al-Hadhdha’ from Muhammad ibn al-Fayd who has said the following: “This is concerning my question before abu ‘Abd Allah, Alayhi al-Salam, about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Yes, if she is knowledgeable.’ We then asked him (the Imam), ‘We pray to Allah to keep our souls in service for your cause, what happens if she is not knowledgeable?’ He (the Imam) said, ‘Propose to her if she agrees then marry her, if she refuses to accept your words then stay away from her. You must remain on your guard against al-Kawashif, al- Dawa‘iy, al-Baghaya’ and Dhaxvat al-Azwaj.’ I then asked who are al-Kaxvashif?’ He (the Imam) said, ‘They are those whose houses are known to people and people go to them.’ I asked about al-Dawa‘iy and he (the Imam) said, ‘They are those women who call people to themselves and who are known for indecent acts.’ I then asked about al-Baghaya’ and he (the Imam) said, They are those who are known for their committing fornication.’ I then asked about Dhaxvat al-Azwaj and he (the Imam) said, They are those who are not divorced according to the Sunnah.’”

6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ يُونُسَ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلام) عَنِ الْمَرْأَةِ الْحَسْنَاءِ الْفَاجِرَةِ هَلْ يَجُوزُ لِلرَّجُلِ أَنْ يَتَمَتَّعَ مِنْهَا يَوْماً أَوْ أَكْثَرَ فَقَالَ إِذَا كَانَتْ مَشْهُورَةً بِالزِّنَا فَلا يَتَمَتَّعْ مِنْهَا وَلا يَنْكِحْهَا.

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from Muhammad ibn af-Fudayl who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about the case of a woman who was beautiful but was involved in indecent acts if it was permissible to form al-Mut‘ah (advantageous marriage) with her for a day or more. He (the Imam) said, ’If she is known as a fornicator then al-Mut‘ah (advantageous marriage) is not proper with her as well as marriage.’”
