Marriage with Two Sisters at the Same Time: Free or Slave-girls

1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ جَمِيعاً عَنِ ابْنِ أَبِي نَجْرَانَ وَأَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ مُحَمَّدِ بْنِ قَيْسٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ قَضَى أَمِيرُ الْمُؤْمِنِينَ (عَلَيْهِ السَّلام) فِي أُخْتَيْنِ نَكَحَ إِحْدَاهُمَا رَجُلٌ ثُمَّ طَلَّقَهَا وَهِيَ حُبْلَى ثُمَّ خَطَبَ أُخْتَهَا فَجَمَعَهُمَا قَبْلَ أَنْ تَضَعَ أُخْتُهَا الْمُطَلَّقَةُ وَلَدَهَا فَأَمَرَهُ أَنْ يُفَارِقَ الأخِيرَةَ حَتَّى تَضَعَ أُخْتُهَا الْمُطَلَّقَةُ وَلَدَهَا ثُمَّ يَخْطُبُهَا وَيُصْدِقُهَا صَدَاقاً مَرَّتَيْنِ.
1. Ali ibn Ibrahim has narrated from his father and A number of our people have narrated from Sahl ibn Ziyad all from ibn abu Najran and Ahmad ibn Muhammad from ibn abu Nasr from ‘Asem ibn Hamid from Muhammad ibn Qays who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin, ‘Alayhi al-Salam, issued a judgment about the case of two sisters, of whom one had married a man who divorced her, and she was pregnant, then proposed marriage to her sister and married her before her divorced sister gave birth, he (the Imam) commanded them to separate from the one married last until her sister gives birth, then he can propose marriage to her and assign mahr (dower) for her twice.’”

2- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ ابْنِ مُسْكَانَ عَنْ أَبِي بَكْرٍ الْحَضْرَمِيِّ قَالَ قُلْتُ لأبِي جَعْفَرٍ (عَلَيْهِ السَّلام) رَجُلٌ نَكَحَ امْرَأَةً ثُمَّ أَتَى أَرْضاً فَنَكَحَ أُخْتَهَا وَهُوَ لا يَعْلَمُ قَالَ يُمْسِكُ أَيَّتَهُمَا شَاءَ وَيُخَلِّي سَبِيلَ الأخْرَى.
2. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ibn Muskan from abu Bakr al- Hadramiy who has said the following: “I once asked abu Ja’far, ‘Alayhi al-Salam, about the case of a man who marries a woman and then comes to a land where he marries her sister but he does not know. He (the Imam) said, ’He can keep whichever he wants and allow the other one to go.’”

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ بَعْضِ أَصْحَابِهِ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) أَنَّهُ قَالَ فِي رَجُلٍ تَزَوَّجَ أُخْتَيْنِ فِي عَقْدَةٍ وَاحِدَةٍ قَالَ هُوَ بِالْخِيَارِ يُمْسِكُ أَيَّتَهُمَا شَاءَ وَيُخَلِّي سَبِيلَ الأخْرَى وَقَالَ فِي رَجُلٍ كَانَتْ لَهُ جَارِيَةٌ فَوَطِئَهَا ثُمَّ اشْتَرَى أُمَّهَا أَوِ ابْنَتَهَا قَالَ لا تَحِلُّ لَهُ [أَبَداً].

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj from certain persons of his people who have said the following: “About the case of a man who marries two sisters in one marriage, one of the two Imam, (abu Ja’far or abu ’Abd Allah), ‘Alayhim al-Salam, has said, ‘He has the choice to keep whichever he wants and allow the other one to go.’ About the case of a man who had a slave-girl with whom he went to bed, then bought her mother or her daughter, he (the Imam) said, ’She is unlawful for him forever.’”

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنِ ابْنِ بُكَيْرٍ وَعَلِيِّ بْنِ رِئَابٍ عَنْ زُرَارَةَ بْنِ أَعْيَنَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ تَزَوَّجَ بِالْعِرَاقِ امْرَأَةً ثُمَّ خَرَجَ إِلَى الشَّامِ فَتَزَوَّجَ امْرَأَةً أُخْرَى فَإِذَا هِيَ أُخْتُ امْرَأَةٍ الَّتِي بِالْعِرَاقِ قَالَ يُفَرَّقُ بَيْنَهُ وَبَيْنَ الَّتِي تَزَوَّجَهَا بِالشَّامِ وَلا يَقْرَبُ الْمَرْأَةَ حَتَّى تَنْقَضِيَ عِدَّةُ الشَّامِيَّةِ قُلْتُ فَإِنْ تَزَوَّجَ امْرَأَةً ثُمَّ تَزَوَّجَ أُمَّهَا وَهُوَ لا يَعْلَمُ أَنَّهَا أُمُّهَا قَالَ قَدْ وَضَعَ اللهُ عَنْهُ جَهَالَتَهُ بِذَلِكَ ثُمَّ قَالَ إِذَا عَلِمَ أَنَّهَا أُمُّهَا فَلا يَقْرَبْهَا وَلا يَقْرَبِ الابْنَةَ حَتَّى تَنْقَضِيَ عِدَّةُ الأمِّ مِنْهُ فَإِذَا انْقَضَتْ عِدَّةُ الأمِّ حَلَّ لَهُ نِكَاحُ الابْنَةِ قُلْتُ فَإِنْ جَاءَتِ الأمُّ بِوَلَدٍ قَالَ هُوَ وَلَدُهُ وَيَكُونُ ابْنَهُ وَأَخَا امْرَأَتِهِ‏.
4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from ibn Bukayr and Ali ibn Ri’ab from Zurarah ibn ‘A‘yan who has said the following: “This is concerning my question before abu Ja’far, ‘Alayhi al-Salam, about the case of a man who marries in Iraq a woman; then goes to al-Sham (Syria) and marries another there who is the sister of the one in Iraq. He (the Imam) said, ‘He must separate from the one in al-Sham and must not go close to the woman until waiting period of the woman in al-Sham is complete.’ I then asked, ‘What happens if one marries a woman then marries her mother in ignorance?’ He (the Imam) said, ‘Allah has exempted people in their ignorance.’ Then he (the Imam) said, ‘When he comes to know that she is her mother he must not go close to her as well as to her daughter until waiting period of the mother is complete and when waiting period of mother is complete marriage with daughter becomes lawful.’ I then asked, ‘What happens if the mother gives birth?’ He (the Imam) said, ‘He is his child and thus his son becomes brother of his wife.’”

5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ إِسْمَاعِيلَ بْنِ مَرَّارٍ عَنْ يُونُسَ قَالَ قَرَأْتُ فِي كِتَابِ رَجُلٍ إِلَى أَبِي الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) جُعِلْتُ فِدَاكَ الرَّجُلُ يَتَزَوَّجُ الْمَرْأَةَ مُتْعَةً إِلَى أَجَلٍ مُسَمًّى فَيَنْقَضِي الأجَلُ بَيْنَهُمَا هَلْ لَهُ أَنْ يَنْكِحَ أُخْتَهَا مِنْ قَبْلِ أَنْ تَنْقَضِيَ عِدَّتُهَا فَكَتَبَ لا يَحِلُّ لَهُ أَنْ يَتَزَوَّجَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا.
5. Ali ibn Ibrahim has narrated from his father from ‘Isma’il ibn Marrar from Yunus who has said the following: “I read in the letter of a man to al-Rida’, ‘Alayhi al-Salam, that said, ‘I pray to Allah to keep my soul in service for your cause, if a man marries a woman in the manner of Mut‘ah for an appointed time which expires; if he can marry her sister before her sister completes her waiting period.’ He (the Imam) had written to him, ‘It is not lawful for him to marry before her waiting period is complete.’”

6- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ بْنِ بَزِيعٍ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ عَنْ أَبِي الصَّبَّاحِ الْكِنَانِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ اخْتَلَعَتْ مِنْهُ امْرَأَتُهُ أَيَحِلُّ لَهُ أَنْ يَخْطُبَ أُخْتَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا فَقَالَ إِذَا بَرِئَتْ عِصْمَتُهَا وَلَمْ يَكُنْ لَهُ رَجْعَةٌ فَقَدْ حَلَّ لَهُ أَنْ يَخْطُبَ أُخْتَهَا قَالَ وَسُئِلَ عَنْ رَجُلٍ عِنْدَهُ أُخْتَانِ مَمْلُوكَتَانِ فَوَطِئَ إِحْدَاهُمَا ثُمَّ وَطِئَ الأخْرَى قَالَ إِذَا وَطِئَ الأخْرَى فَقَدْ حَرُمَتْ عَلَيْهِ الأولَى حَتَّى تَمُوتَ الأخْرَى قُلْتُ أَرَأَيْتَ إِنْ بَاعَهَا فَقَالَ إِنْ كَانَ إِنَّمَا يَبِيعُهَا لِحَاجَةٍ وَلا يَخْطُرُ عَلَى بَالِهِ مِنَ الأخْرَى شَيْ‏ءٌ فَلا أَرَى بِذَلِكَ بَأْساً وَإِنْ كَانَ إِنَّمَا يَبِيعُهَا لِيَرْجِعَ إِلَى الأولَى فَلا.
6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Muhammad ibn ‘Isma’il ibn Bazi’ from Muhammad ibn al-Fadl from abu al-Sabbah al-Kinaniy who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man whose wife divorces him in the manner of al-Khula‘ (payment for divorce); if it is permissible to propose marriage to her sister before her waiting period is complete. He (the Imam) said, ‘Since she has set herself free and there is no chance to go back, it is lawful for him to propose marriage to her sister.’ He (the narrator) has said that he (the Imam) was asked about the case of a man who had two sisters as his slave-girls. He goes to bed with one of them then he goes to bed with the other one. He (the Imam) said, ‘When he goes to bed with the other one, the first one becomes unlawful for him until the other one dies.’ I then asked, ‘What happens if he sells her?’ He (the Imam) said, ‘If he sells her because of a reason without anything in his mind about the other slave-girl, then I do not see it as harmful, but if he sells her so he can go to the first one, then it is not permissible.’”

7- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ أَوِ اخْتَلَعَتْ أَوْ بَانَتْ أَلَهُ أَنْ يَتَزَوَّجَ بِأُخْتِهَا قَالَ فَقَالَ إِذَا بَرِئَتْ عِصْمَتُهَا وَلَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ فَلَهُ أَنْ يَخْطُبَ أُخْتَهَا قَالَ وَسُئِلَ عَنْ رَجُلٍ كَانَتْ عِنْدَهُ أُخْتَانِ مَمْلُوكَتَانِ فَوَطِئَ إِحْدَاهُمَا ثُمَّ وَطِئَ الأخْرَى قَالَ إِذَا وَطِئَ الأخْرَى فَقَدْ حَرُمَتْ عَلَيْهِ حَتَّى تَمُوتَ الأخْرَى قُلْتُ أَرَأَيْتَ إِنْ بَاعَهَا أَتَحِلُّ لَهُ الأولَى قَالَ إِنْ كَانَ يَبِيعُهَا لِحَاجَةٍ وَلا يَخْطُرُ عَلَى قَلْبِهِ مِنَ الأخْرَى شَيْ‏ءٌ فَلا أَرَى بِذَلِكَ بَأْساً وَإِنْ كَانَ إِنَّمَا يَبِيعُهَا لِيَرْجِعَ إِلَى الأولَى فَلا وَلا كَرَامَةَ.
7. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Hammad from al-Halabiy who has said the following: “About the case of a man who divorces his wife or she arranges for KhuT (payment for divorce) or she becomes a stranger to him; if he can marry her sister. He (the Imam) said, ‘When she has freed herself from responsibility and he is not able to go back to her, it then is permissible for him to propose marriage to her sister.’ He (the narrator) has said that he (the Imam) was asked about the case of a man who has two sisters as his slave-girls. He goes to bed with one of them, then he goes to bed with the other one. He (the Imam) said, ‘When he goes to bed with the other one the first one becomes unlawful for him until the other one dies.’ I then asked, ‘What happens if he sells her?’ He (the Imam) said, ‘If he sells her because of a reason without anything in his mind about the other slave-girl, then I do not see it as harmful; but if he sells her so he can go to the first one, then it is not permissible and it is not honorable.’”

8- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ وَهِيَ حُبْلَى أَيَتَزَوَّجُ أُخْتَهَا قَبْلَ أَنْ تَضَعَ قَالَ لا يَتَزَوَّجُهَا حَتَّى يَخْلُوَ أَجَلُهَا.
8. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Zurarah who has said the following: “About the case of a man who divorces his wife and she is pregnant; if he can marry her sister before she gives birth, he (the Imam), ‘Alayhi al-Salam, has said, ‘He must not marry her until her time is complete.’”

9- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي إِبْرَاهِيمَ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَةً أَيَتَزَوَّجُ أُخْتَهَا قَالَ لا حَتَّى تَنْقَضِيَ عِدَّتُهَا قَالَ وَسَأَلْتُهُ عَنْ رَجُلٍ مَلَكَ أُخْتَيْنِ أَيَطَؤُهُمَا جَمِيعاً قَالَ يَطَأُ إِحْدَاهُمَا وَإِذَا وَطِئَ الثَّانِيَةَ حَرُمَتْ عَلَيْهِ الأولَى الَّتِي وَطِئَ حَتَّى تَمُوتَ الثَّانِيَةُ أَوْ يُفَارِقَهَا وَلَيْسَ لَهُ أَنْ يَبِيعَ الثَّانِيَةَ مِنْ أَجْلِ الأولَى لِيَرْجِعَ إِلَيْهَا إِلا أَنْ يَبِيعَ لِحَاجَةٍ أَوْ يَتَصَدَّقَ بِهَا أَوْ تَمُوتَ قَالَ وَسَأَلْتُهُ عَنْ رَجُلٍ كَانَتْ لَهُ امْرَأَةٌ فَهَلَكَتْ أَيَتَزَوَّجُ أُخْتَهَا فَقَالَ مِنْ سَاعَتِهِ إِنْ أَحَبَّ.
9. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah who has said the following: “This is concerning my question before abu al-Hassan, ‘Alayhi al-Salam, about the case of a man who divorces a woman; if he can marry her sister. He (the Imam) said, ‘No, he cannot do so until her waiting period is complete.’ He (the narrator) has said, ‘I asked him (the Imam) about the case of a man who owns two sisters; if he can go to bed with both of them. He (the Imam) said, ‘He can go to bed with one of them. When he goes to bed with the second one, the first one becomes unlawful for him until the second one dies or separates from her and he cannot sell the second in order to go to the first one unless he sells for a reason or gives her in charity or she dies.’ He (the narrator) has said, ‘I asked him (the Imam) about the case of a man who had a woman who died; if he could marry her sister. He (the Imam) said, ‘He can do so at the same hour if he likes.’”

10- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ كَانَتْ لَهُ جَارِيَةٌ فَعَتَقَتْ فَتَزَوَّجَتْ فَوَلَدَتْ أَيَصْلُحُ لِمَوْلاهَا الأوَّلِ أَنْ يَتَزَوَّجَ ابْنَتَهَا قَالَ هِيَ عَلَيْهِ حَرَامٌ وَهِيَ ابْنَتُهُ وَالْحُرَّةُ وَالْمَمْلُوكَةُ فِي هَذَا سَوَاءٌ ثُمَّ قَرَأَ هَذِهِ الآيَةَ وَرَبائِبُكُمُ اللاتِي فِي حُجُورِكُمْ مِنْ نِسائِكُمُ. مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) مِثْلَهُ.
10. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who has a slave-girl and sets her free. She then marries and gives birth; if her first master can marry her daughter. He (the Imam) said, ’She is unlawful for him because she is his daughter, free and slaves are the same in this issue.’ Then he (the Imam) read this verse, . . the ones who grow in your care from your wives.’ (4:23)” Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from al-’Ala’ ibn Razin from Muhammad ibn Muslim from one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhi al-Salam, a similar Hadith.

11- أَحْمَدُ بْنُ مُحَمَّدٍ عَمَّنْ ذَكَرَهُ عَنِ الْحُسَيْنِ بْنِ بِشْرٍ قَالَ سَأَلْتُ الرِّضَا (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ تَكُونُ لَهُ الْجَارِيَةُ وَلَهَا ابْنَةٌ فَيَقَعُ عَلَيْهَا أَيَصْلُحُ لَهُ أَنْ يَقَعَ عَلَى ابْنَتِهَا فَقَالَ أَيَنْكِحُ الرَّجُلُ الصَّالِحُ ابْنَتَهُ.
11. Ahmad ibn Muhammad has narrated from those whom he has mentioned from al-Husayn ibn Bishr who has said the following: “I once asked al-Rida’, ‘Alayhi al-Salam, about the case of a man who had a slave-girl who had a daughter. He falls on her (for sexual intercourse); if he could fall on her daughter. He (the Imam) said, ‘Does a man of good deeds marry his own daughter?”’

12- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنِ الْقَاسِمِ بْنِ سُلَيْمَانَ عَنْ عُبَيْدِ بْنِ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ يَكُونُ لَهُ الْجَارِيَةُ يُصِيبُ مِنْهَا أَلَهُ أَنْ يَنْكِحَ ابْنَتَهَا قَالَ لا هِيَ مِثْلُ قَوْلِ اللهِ عَزَّ وَجَلَّ وَرَبائِبُكُمُ اللاتِي فِي حُجُورِكُمْ.
12. Ahmad ibn Muhammad from has narrated from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from al-Qasim ibn Sulayman from ‘Ubayd ibn Zurarah who has said the following: “About the case of a man who has a slave-girl with whom he has gone to bed; if he can marry her daughter, he (the Imam) said, ‘No, he cannot do so because of the words of Allah, most Majestic, most Glorious, “. . . those who grow in your care . . .” (4:23)’”

13- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ ابْنِ مُسْكَانَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ رَجُلٌ طَلَّقَ امْرَأَتَهُ فَبَانَتْ مِنْهُ وَلَهَا ابْنَةٌ مَمْلُوكَةٌ فَاشْتَرَاهَا أَيَحِلُّ لَهُ أَنْ يَطَأَهَا قَالَ لا وَعَنِ الرَّجُلِ تَكُونُ عِنْدَهُ الْمَمْلُوكَةُ وَابْنَتُهَا فَيَطَأُ إِحْدَاهُمَا فَتَمُوتُ وَتَبْقَى الأخْرَى أَيَصْلُحُ لَهُ أَنْ يَطَأَهَا قَالَ لا.
13. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ibn Muskan from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who divorces his wife and they become strangers to each other. She has a daughter who is a slave and he buys her; if he can go to bed with her. He (the Imam) said, ‘No, he cannot do so.’ I asked him (the Imam) about the case of a man who has a slave-girl and her daughter and he goes to bed with one of them, then she dies and the other is living; if he can go to bed with her. He (the Imam) said, ‘No, he cannot do so.’”

14- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ الرَّجُلُ يَشْتَرِي الأخْتَيْنِ فَيَطَأُ إِحْدَاهُمَا ثُمَّ يَطَأُ الأخْرَى بِجَهَالَةٍ قَالَ إِذَا وَطِئَ الأخْرَى بِجَهَالَةٍ لَمْ تَحْرُمْ عَلَيْهِ الأولَى وَإِنْ وَطِئَ الأخْرَى وَهُوَ يَعْلَمُ أَنَّهَا تَحْرُمُ عَلَيْهِ حَرُمَتَا عَلَيْهِ جَمِيعاً.
14. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn Ri’ab from al-Halabiy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who buys two sisters and goes to bed with one of them, then goes to bed with the other due to ignorance. He (the Imam) said, ‘If he has gone to bed with the other due to ignorance the first one does not become unlawful for him but if he goes to bed with the other knowing that it is unlawful, both of them become unlawful for him.’”
