1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَلامَسَهَا قَالَ مَهْرُهَا وَاجِبٌ وَهِيَ حَرَامٌ عَلَى أَبِيهِ وَابْنِهِ.
1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from af-Halabiy who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman and has touched her. He (the Imam) said, ‘Her mahr (dower) is obligatory and she becomes unlawful for marriage to his father and his son.’”

2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ تَكُونُ لَهُ الْجَارِيَةُ فَيُقَبِّلُهَا هَلْ تَحِلُّ لِوَلَدِهِ قَالَ بِشَهْوَةٍ قُلْتُ نَعَمْ قَالَ فَقَالَ مَا تَرَكَ شَيْئاً إِذَا قَبَّلَهَا بِشَهْوَةٍ ثُمَّ قَالَ ابْتِدَاءً مِنْهُ إِنْ جَرَّدَهَا وَنَظَرَ إِلَيْهَا بِشَهْوَةٍ حَرُمَتْ عَلَى أَبِيهِ وَابْنِهِ قُلْتُ إِذَا نَظَرَ إِلَى جَسَدِهَا فَقَالَ إِذَا نَظَرَ إِلَى فَرْجِهَا وَجَسَدِهَا بِشَهْوَةٍ حَرُمَتْ عَلَيْهِ.
2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “I once asked al-Rida’, ‘Alayhi al-Salam, about the case of a man who had a slave-girl and he kissed her; if she was lawful for his sons. He (the Imam) asked, ‘Was it with lust?’ I replied, ‘Yes, it was with lust.’ He (the Imam) said, ‘He then has left nothing if he has kissed with lust.’ He (the Imam) then initiating said, ‘If he makes her bare and looks at her with lust she becomes unlawful to marry for his father and his son.’ I then asked, ‘What happens if he looks at her body?’ He (the Imam) said, ‘If he looks at her vagina and body with lust she becomes unlawful for him.’”

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) الرَّجُلُ يَنْظُرُ إِلَى الْجَارِيَةِ يُرِيدُ شِرَاهَا أَتَحِلُّ لابْنِهِ فَقَالَ نَعَمْ إِلا أَنْ يَكُونَ نَظَرَ إِلَى عَوْرَتِهَا.

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who looks at a slave-girl whom he wants to buy; if she is lawful for his son. He (the Imam) said, ‘Yes, she is lawful unless he has looked at her private organs.”’

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَبْدِ اللهِ بْنِ يَحْيَى الْكَاهِلِيِّ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَنَا عِنْدَهُ عَنْ رَجُلٍ اشْتَرَى جَارِيَةً وَلَمْ يَمَسَّهَا فَأَمَرَتِ امْرَأَتُهُ ابْنَهُ وَهُوَ ابْنُ عَشْرِ سِنِينَ أَنْ يَقَعَ عَلَيْهَا فَوَقَعَ عَلَيْهَا فَمَا تَرَى فِيهِ فَقَالَ أَثِمَ الْغُلامُ وَأَثِمَتْ أُمُّهُ وَلا أَرَى لِلأبِ إِذَا قَرِبَهَا الابْنُ أَنْ يَقَعَ عَلَيْهَا قَالَ وَسَأَلْتُهُ عَنْ رَجُلٍ يَكُونُ لَهُ جَارِيَةٌ فَيَضَعُ أَبُوهُ يَدَهُ عَلَيْهَا مِنْ شَهْوَةٍ أَوْ يَنْظُرُ مِنْهَا إِلَى مُحَرَّمٍ مِنْ شَهْوَةٍ فَكَرِهَ أَنْ يَمَسَّهَا ابْنُهُ.
4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah ibn Yahya al-Kahiliy who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked, when I was with him (the Imam), about the case of a man who bought a slave-girl but did not touch her. His wife commanded his son, who was ten years old, to fall on her (for sexual intercourse) and he did it, now what do you say about it. He (the Imam) said, ‘The boy has sinned as well as his mother and it is not permissible for the father, after his son’s going near her, to fall on her.’ I then asked him (the Imam) about the case of a man who has a slave-girl and his father places his hand on her with lust or looks where it is not permissible to look with lust. He (the Imam) disliked his son’s touching her.’”

5- مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ رِبْعِيِّ بْنِ عَبْدِ اللهِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِذَا جَرَّدَ الرَّجُلُ الْجَارِيَةَ وَوَضَعَ يَدَهُ عَلَيْهَا فَلا تَحِلُّ لابْنِهِ.
5. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from ibn abu ‘Umayr from Rib’iy ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If a man makes a slave-girl bare and places his hand on her she becomes unlawful for his son.’”

6- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ ابْنِ مُسْكَانَ عَنِ الْحَسَنِ بْنِ زِيَادٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ قُلْتُ لَهُ رَجُلٌ تَزَوَّجَ امْرَأَةً فَلَمَسَهَا قَالَ هِيَ حَرَامٌ عَلَى أَبِيهِ وَابْنِهِ وَمَهْرُهَا وَاجِبٌ.
6. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ibn Muskan from al-Hassan ibn Ziyad from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who has married a woman and has touched her. He (the Imam), ‘Alayhi al-Salam, said, ‘She is unlawful to his father and her mahr (dower) is obligatory.’”

7- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ زُرَارَةَ قَالَ قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) إِذَا زَنَى رَجُلٌ بِامْرَأَةِ أَبِيهِ أَوْ جَارِيَةِ أَبِيهِ فَإِنَّ ذَلِكَ لا يُحَرِّمُهَا عَلَى زَوْجِهَا وَلا تُحَرِّمُ الْجَارِيَةَ عَلَى سَيِّدِهَا إِنَّمَا يُحَرِّمُ ذَلِكَ مِنْهُ إِذَا أَتَى الْجَارِيَةَ وَهِيَ حَلالٌ فَلا تَحِلُّ تِلْكَ الْجَارِيَةُ أَبَداً لابْنِهِ وَلا لأبِيهِ وَإِذَا تَزَوَّجَ رَجُلٌ امْرَأَةً تَزْوِيجاً حَلالا فَلا تَحِلُّ تِلْكَ الْمَرْأَةُ لأبِيهِ وَلابْنِهِ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘If a man commits fornication with the woman of his father or his slave-girl, it does not make her unlawful to her husband or the slave-girl unlawful to her master. If he goes to bed with a slave-girl who is lawful thereafter she becomes unlawful forever to his son and father. If a man marries a woman in a lawful way, that woman is not lawful for his father and son for marriage.

8- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ مُرَازِمٍ قَالَ سَمِعْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَسُئِلَ عَنِ امْرَأَةٍ أَمَرَتِ ابْنَهَا أَنْ يَقَعَ عَلَى جَارِيَةٍ لأبِيهِ فَوَقَعَ فَقَالَ أَثِمَتْ وَأَثِمَ ابْنُهَا وَقَدْ سَأَلَنِي بَعْضُ هَؤُلاءِ عَنْ هَذِهِ الْمَسْأَلَةِ فَقُلْتُ لَهُ أَمْسِكْهَا إِنَّ الْحَلالَ لا يُفْسِدُهُ الْحَرَامُ.
8. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from Hammad ibn ‘Uthaman from Murazim who has said the following: “I once heard abu ‘Abd Allah, ‘Alayhi al-Salam, saying, when he (the Imam) was asked about the case of a woman who commanded her son to fall on the slave-girl of his father and he did, ‘She has sinned and so has her son and certain ones of these people asked me about it and I said, “You can keep her because unlawful does not make lawful ones unlawful.’””

9- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُوسَى بْنِ جَعْفَرٍ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ تَكُونُ لَهُ الْجَارِيَةُ فَيَقَعُ عَلَيْهَا ابْنُ ابْنِهِ قَبْلَ أَنْ يَطَأَهَا الْجَدُّ أَوِ الرَّجُلُ يَزْنِي بِالْمَرْأَةِ فَهَلْ يَحِلُّ لأبِيهِ أَنْ يَتَزَوَّجَهَا قَالَ لا إِنَّمَا ذَلِكَ إِذَا تَزَوَّجَهَا الرَّجُلُ فَوَطِئَهَا ثُمَّ زَنَى بِهَا ابْنُهُ لَمْ يَضُرَّهُ لأنَّ الْحَرَامَ لا يُفْسِدُ الْحَلالَ وَكَذَلِكَ الْجَارِيَةُ.
9. A number of our people have narrated from Sahl ibn Ziyad from Musa ibn Ja’far from “Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar who has said the following: “About the case of a man who has a slave-girl and his grandson falls on her (does sexual intercourse) before his grandfather or that a man commits fornication with a woman; if she is lawful for his father to marry, abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘No, it is not permissible. Only if the man marries her and goes to bed with her then his son commits fornication with her it does not harm him because unlawful does not make lawful ones unlawful and so also is the case of the slave-girl.’”
