Marriage after Conjugal Relations Out of Wedlock

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ أَحْمَدَ بْنِ الْحَسَنِ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَمَّارِ بْنِ مُوسَى عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَحِلُّ لَهُ أَنْ يَتَزَوَّجَ امْرَأَةً كَانَ يَفْجُرُ بِهَا فَقَالَ إِنْ آنَسَ مِنْهَا رُشْداً فَنَعَمْ وَإِلا فَلْيُرَاوِدَنَّهَا عَلَى الْحَرَامِ فَإِنْ تَابَعَتْهُ فَهِيَ عَلَيْهِ حَرَامٌ وَإِنْ أَبَتْ فَلْيَتَزَوَّجْهَا.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ahmad ibn al-Hassan from ‘Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar ibn Musa who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who has committed fornication with a woman; if he can marry her. He (the Imam) said, if he finds her to have gained wisdom then he can do so, otherwise, he can try her by offering unlawful choices; if she follows then it is unlawful for him to marry; but if she refuses he then can marry her.’”

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ عُبَيْدِ اللهِ بْنِ عَلِيٍّ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ أَيُّمَا رَجُلٍ فَجَرَ بِامْرَأَةٍ ثُمَّ بَدَا لَهُ أَنْ يَتَزَوَّجَهَا حَلالا قَالَ أَوَّلُهُ سِفَاحٌ وَآخِرُهُ نِكَاحٌ وَمَثَلُهُ مَثَلُ النَّخْلَةِ أَصَابَ الرَّجُلُ مِنْ ثَمَرِهَا حَرَاماً ثُمَّ اشْتَرَاهَا بَعْدُ فَكَانَتْ لَهُ حَلالا.
2. Ali ibn Ibrahim has narrated from his father from Muhammad ibn abu ‘Umayr from Hammad ibn ‘Uthman from ‘Ubayd Allah ibn Ali al-Halabiy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, Tf a man commits indecent act (goes to bed with her out of wedlock) with a woman and then decides to marry her, it is a case of indecency in the beginning and then marriage, like a palm tree that one uses its fruit in an unlawful manner then buys the whole tree in a lawful manner and it thereafter is all lawful.”’

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ فَجَرَ بِامْرَأَةٍ ثُمَّ بَدَا لَهُ أَنْ يَتَزَوَّجَهَا فَقَالَ حَلالٌ أَوَّلُهُ سِفَاحٌ وَآخِرُهُ نِكَاحٌ أَوَّلُهُ حَرَامٌ وَآخِرُهُ حَلالٌ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who commits an indecent act (goes to bed with her out of wedlock), then decides to marry her. He (the Imam) said, ‘It is lawful, although in the beginning, it is indecency, and at the end is marriage; in the beginning, (it is) unlawful and in the end becomes lawful.’”

4- مُحَمَّدُ بْنُ يَحْيَى عَنْ بَعْضِ أَصْحَابِنَا عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ إِسْحَاقَ بْنِ جَرِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ الرَّجُلُ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَبْدُو لَهُ فِي تَزْوِيجِهَا هَلْ يَحِلُّ لَهُ ذَلِكَ قَالَ نَعَمْ إِذَا هُوَ اجْتَنَبَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا بِاسْتِبْرَاءِ رَحِمِهَا مِنْ مَاءِ الْفُجُورِ فَلَهُ أَنْ يَتَزَوَّجَهَا وَإِنَّمَا يَجُوزُ لَهُ أَنْ يَتَزَوَّجَهَا بَعْدَ أَنْ يَقِفَ عَلَى تَوْبَتِهَا.
4. Muhammad ibn Yahya has narrated from certain persons of our people from ‘Uthman ibn ‘Isa from Ishaq ibn Jarir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who commits an indecent act (goes to bed with her out of wedlock) with a woman and then decides to marry her; if it is lawful for him. He (the Imam) said, ‘Yes, it is lawful if he waits until her waiting period is complete to cleans her womb from indecent activities; then he can marry her and it is only when he ascertains that she has repented.’”
