Chapter 28(a) - The Case of Gift to a Creditor

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ يَحْيَى عَنْ غِيَاثِ بْنِ إِبْرَاهِيمَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِنَّ رَجُلا أَتَى عَلِيّاً (عَلَيْهِ السَّلام) فَقَالَ لَهُ إِنَّ لِي عَلَى رَجُلٍ دَيْناً فَأَهْدَى إِلَيَّ هَدِيَّةً قَالَ (عَلَيْهِ السَّلام) احْسُبْهُ مِنْ دَيْنِكَ عَلَيْهِ.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said that once a man came to Ali, ‘Alayhi al-Salam, and said, ‘Someone who owes to me a certain amount of debts has sent me a gift.’ He (the Imam) Alayhi al- Salam, said, ‘Count it as part of payment for what he owes you.’”

2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَسَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ هُذَيْلِ بْنِ حَيَّانَ أَخِي جَعْفَرِ بْنِ حَيَّانَ الصَّيْرَفِيِّ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنِّي دَفَعْتُ إِلَى أَخِي جَعْفَرٍ مَالا فَهُوَ يُعْطِينِي مَا أُنْفِقُهُ وَأَحُجُّ مِنْهُ وَأَتَصَدَّقُ وَقَدْ سَأَلْتُ مَنْ قِبَلَنَا فَذَكَرُوا أَنَّ ذَلِكَ فَاسِدٌ لا يَحِلُّ وَأَنَا أُحِبُّ أَنْ أَنْتَهِيَ إِلَى قَوْلِكَ فَقَالَ لِي أَكَانَ يَصِلُكَ قَبْلَ أَنْ تَدْفَعَ إِلَيْهِ مَالَكَ قُلْتُ نَعَمْ قَالَ فَخُذْ مِنْهُ مَا يُعْطِيكَ فَكُلْ مِنْهُ وَاشْرَبْ وَحُجَّ وَتَصَدَّقْ فَإِذَا قَدِمْتَ الْعِرَاقَ فَقُلْ جَعْفَرُ بْنُ مُحَمَّدٍ أَفْتَانِي بِهَذَا.
2. A number of our people have narrated from Ahmad ibn Muhammad from Sahl ibn Ziyad from ibn Mahbub from Hudhayl ibn Hayyan, brother of Ja’far ibn Hayyan al-Sayrafiy who has said the following: “I once said to abu ‘Abd Allah, Alayhi al-Salam, ‘I have given a certain amount of assets to my brother Ja’far and he gives me what I pay for my expenses, for performing al-Hajj and giving charity. I asked certain people for both of us and they mentioned that it is invalid and unlawful. I like to take your words as the final ones.’ He (the Imam) asked, ‘Did he give you such things before you gave him the assets you just mentioned?’ I replied, ‘Yes, he did so.’ He (the Imam) then said, ‘You can take what he gives you, use it for food, drink, al-Hajj and charity, and when you go back to Iraq tell him that Ja’far ibn Muhammad has given me this fatwa.’”

3- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ مُوسَى بْنِ سَعْدَانَ عَنِ الْحُسَيْنِ بْنِ أَبِي الْعَلاءِ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي الْحَسَنِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَكُونُ لَهُ عَلَى رَجُلٍ مَالٌ قَرْضاً فَيُعْطِيهِ الشَّيْءَ مِنْ رِبْحِهِ مَخَافَةَ أَنْ يَقْطَعَ ذَلِكَ عَنْهُ فَيَأْخُذَ مَالَهُ مِنْ غَيْرِ أَنْ يَكُونَ شَرَطَ عَلَيْهِ قَالَ لا بَأْسَ بِذَلِكَ مَا لَمْ يَكُنْ شَرْطاً.
3. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Musa ibn Sa‘dan from al-Husayn ibn abu al-‘Ala’ from Ishaq ibn ‘Ammar who has said the following: “I once asked abu al-Hassan, Alayhi al-Salam, about the case of a man who is a debtor and pays a certain amount out of his profit to his creditor for fear of the creditor’s demand for payment, but there is no such condition between them. He (the Imam) said, ‘It is not harmful as long as it is not a condition.’”
