The Case of Delaying Due Payment

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنْ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ كَانَ أَمِيرُ الْمُؤْمِنِينَ (صَلَّى اللهُ عَلَيْهِ وَآلِه) يَحْبِسُ الرَّجُلَ إِذَا الْتَوَى عَلَى غُرَمَائِهِ ثُمَّ يَأْمُرُ فَيَقْسِمُ مَالَهُ بَيْنَهُمْ بِالْحِصَصِ فَإِنْ أَبَى بَاعَهُ فَيَقْسِمُ يَعْنِي مَالَهُ.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ‘Ammar who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said that ‘Amir al-Mu’minin, ‘Alayhi al-Salam, would keep in custody a procrastinating debtor; then command to distribute his assets among his creditors proportionate to their shares, and if he (the debtor) disagreed, he (the Imam) sold his assets, then distributed it among his creditors.’”

2- أَحْمَدُ بْنُ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَسَنِ عَنْ جَعْفَرِ بْنِ مُحَمَّدِ بْنِ حَكِيمٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ الْغَائِبُ يُقْضَى عَنْهُ إِذَا قَامَتِ الْبَيِّنَةُ عَلَيْهِ وَيُبَاعُ مَالُهُ وَيُقْضَى عَنْهُ وَهُوَ غَائِبٌ وَيَكُونُ الْغَائِبُ عَلَى حُجَّتِهِ إِذَا قَدِمَ وَلا يُدْفَعُ الْمَالُ إِلَى الَّذِي أَقَامَ الْبَيِّنَةَ إِلا بِكُفَلاءَ إِذَا لَمْ يَكُنْ مَلِيّاً.

Ahmad ibn Muhammad has narrated from Ali ibn al-Hassan from Ja’far ibn Muhammad ibn Hakim from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘The debt of an absent person is paid from his assets when enough proof is presented to prove his indebtedness. His assets are sold to make necessary payments in his absence and he faces the proof against him. One who has presented proofs receives payments upon providing guarantee and security, if he does not want to wait.’”
