Chapter 13(b)

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ بَعْضِ أَصْحَابِ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي السَّبِيِّ يَأْخُذُهُ الْعَدُوُّ مِنَ الْمُسْلِمِينَ فِي الْقِتَالِ مِنْ أَوْلادِ الْمُسْلِمِينَ أَوْ مِنْ مَمَالِيكِهِمْ فَيَحُوزُونَهُمْ ثُمَّ إِنَّ الْمُسْلِمِينَ بَعْدُ قَاتَلُوهُمْ فَظَفِرُوا بِهِمْ وَسَبَوْهُمْ وَأَخَذُوا مِنْهُمْ مَا أَخَذُوا مِنْ مَمَالِيكِ الْمُسْلِمِينَ وَأَوْلادِهِمُ الَّذِينَ كَانُوا أَخَذُوهُ مِنَ الْمُسْلِمِينَ كَيْفَ يُصْنَعُ بِمَا كَانُوا أَخَذُوهُ مِنْ أَوْلادِ الْمُسْلِمِينَ وَمَمَالِيكِهِمْ قَالَ فَقَالَ أَمَّا أَوْلادُ الْمُسْلِمِينَ فَلا يُقَامُونَ فِي سِهَامِ الْمُسْلِمِينَ وَلَكِنْ يُرَدُّونَ إِلَى أَبِيهِمْ أَوْ أَخِيهِمْ أَوْ إِلَى وَلِيِّهِمْ بِشُهُودٍ وَأَمَّا الْمَمَالِيكُ فَإِنَّهُمْ يُقَامُونَ فِي سِهَامِ الْمُسْلِمِينَ فَيُبَاعُونَ وَيُعْطَى مَوَالِيهِمْ قِيمَةَ أَثْمَانِهِمْ مِنْ بَيْتِ مَالِ الْمُسْلِمِينَ.
1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Hassan ibn Mahbub from Hisham ibn Salim from certain individuals of his people who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, about the Muslim prisoners, their children or servants (slaves), taken by the enemy who were afterwards rescued after a victorious fight, how should they be dealt with, abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘The children of the Muslims do not become the share of the Muslims. They are returned to their parents, or brothers, or their guardian in the presence of witnesses. The slaves however become of the share of the Muslims. They are purchased with money from public treasury and their price is given to their owners.’”

2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ لَقِيَهُ الْعَدُوُّ وَأَصَابَ مِنْهُ مَالا أَوْ مَتَاعاً ثُمَّ إِنَّ الْمُسْلِمِينَ أَصَابُوا ذَلِكَ كَيْفَ يُصْنَعُ بِمَتَاعِ الرَّجُلِ فَقَالَ إِذَا كَانَ أَصَابُوهُ قَبْلَ أَنْ يَحُوزُوإ؛ مَتَاعَ الرَّجُلِ رُدَّ عَلَيْهِ وَإِنْ كَانَ أَصَابُوهُ بَعْدَ مَا حَازُوهُ فَهُوَ فَيْ‏ءٌ لِلْمُسْلِمِينَ وَهُوَ أَحَقُّ بِالشُّفْعَةِ.
2. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Um ay r from Hammad from al-Halabiy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who is captured by the enemy with his properties. Then the Muslims captured him. ‘How should they deal with his properties?’ He (the Imam) replied, ‘If they capture him before the enemies secure for themselves his properties, they should be returned to him. If they capture him after the enemies secure for themselves his properties, such properties become as Fay’ for the Muslims and he deserves the right of having priority (al-Shuf’ ah) to purchase them before anyone else does.’”
